Constructive dismissal is when an employee resigns but claims they were forced to do so because of their employer’s actions. This is a complicated area of employment law that requires careful consideration from employers. The main issue is whether the employer has committed a “fundamental” or “repudiatory” breach of the employment contract—this includes express and implied terms. If the claim is successful at an employment tribunal, it is treated as an unfair dismissal, which could result in paying employers paying out substantial compensation. Also, the burden of proof falls with the employee, they must satisfy that they had no reasonable alternative other than to resign because of the employer’s actions.
