A contract of employment is a legally binding agreement that sets out the terms and conditions between an employer and employee. It provides a framework for their working relationship, including a comprehensive overview of rights, responsibilities, pay, hours, and benefits. This could be written, verbal, or implied by actions. Whilst a complete written contract isn’t necessarily required, employers must produce a Written Statement of Employment Particulars. On or before the first day of employment, employers must provide a “principal statement” which covers pay, hours, and holiday entitlement. After two months, a broader statement consisting of pension schemes and disciplinary procedures must be given. There are different types of contracts. For example, permanent, fixed-term, zero-hours, and freelance. If any of the agreed terms aren’t followed by either party, this will lead to a breach of contract, which carries significant consequences.
