Victimisation in the workplace will occur when an employee challenges discrimination, or supports someone who faced discrimination, and is treated unfairly or is subjected to detriment because of this. As per the Equality Act 2010, victimisation is a form of unlawful discrimination that’s different from bullying. This is because it’s a direct retaliation to what legislation refers to as a “protected act”. For an act to be legally considered victimisation, two aspects must be satisfied. Firstly, there must be a protected act (such as making a formal or informal complaint about discrimination). Secondly, there must be a detriment—did an employee experience a disadvantage resulting from the act. Protection for employees exists if they acted in “good faith”, meaning there was no malice behind the act. There’s also assumed intent, which is when employees treat a member of staff badly because they think they’ll perform a protected act.
